General Terms and Conditions (GTC) for hang glider passenger flights

Sven Albert offers passenger flights with hang gliders (paragliders) as an independent entrepreneur. The passenger confirms with his signature or by other means that he has read, understood and accepted these GTC. For the sake of clarity, persons are referred to in the masculine form – but all genders are meant.

Conclusion of contract and severability clause

The contract between the parties comes into effect with the binding booking by the passenger. In the event that individual provisions of these GTC are wholly or partially void or ineffective, the validity and effectiveness of the remaining provisions shall remain unaffected.

Payment and vouchers

No flight ticket will be issued. The names of the contracting parties (carrier and passenger) and the fare paid are shown in the correspondence upon conclusion of the contract. The fare must always be paid in cash or by TWINT after the flight.

Vouchers will be sent to the buyer after receipt of payment (payment by bank transfer or TWINT). For more details, please reply by e-mail when booking. Vouchers cannot be refunded.

Pilot and device

The pilot of the passenger flight is in possession of the necessary official authorization. The pilot is the commander of the biplace hang glider and the passenger undertakes to follow his instructions. The hang glider used is suitable for passenger flights and is properly maintained. The pilot carries a rescue device (emergency parachute).

Passenger health and equipment

The passenger confirms that he/she does not suffer from any health problems (mental or physical) that could affect the safe performance of a passenger flight with a hang glider. In case of doubt, the passenger shall inform alpstein-paragliding.ch (Sven Albert) or [the pilot] at the latest during preparations for take-off. In such a case, a joint decision should be made as to whether the passenger flight can be carried out. The final decision lies with the pilot. The passenger undertakes to wear a suitable helmet of his/her own or the one provided and sturdy footwear. The pilot may impose additional requirements (e.g. long pants, warm clothing, etc.).

Disclaimer

The passenger is aware that taking part in a hang glider flight is associated with risks. For example, as the landing gear of hang gliders corresponds to the legs of the pilot and passenger, injuries can occur in the event of hard landings or aborted take-offs. In addition, the risk of sudden, unforeseeable wind influences cannot be ruled out. The liability of alpstein-paragliding.ch (Sven Albert) and the pilot for bodily injury and property damage incurred by the passenger during a hang gliding flight is expressly excluded. In the event that an exclusion of liability is not possible for legal reasons, alpstein-paragliding.ch (Sven Albert) has taken out liability insurance with a maximum cover of CHF 5,000,000. In such cases, the liability of alpstein-paragliding.ch (Sven Albert) is limited to a maximum of this amount.

Minors or underage passengers

Minors or incapacitated passengers require the consent of a holder of parental authority or a legal representative. If such a person is not present at the time of the flight, a written declaration of consent must be submitted to alpstein-paragliding.ch (Sven Albert) in advance.

Date, venue, duration and cancellation by the organizer

Dates for passenger flights are agreed in advance (even at short notice). Changes to the date of the flight may be necessary due to weather conditions or for organizational reasons. The pilot makes the final decision as to whether or not it is possible to carry out a passenger flight. If possible, the passenger flight will be postponed to the next available date. If an alternative date is not possible and the reasons for the cancellation of the original date do not lie with the passenger, the passenger may demand a refund of the fare paid. The duration of a passenger flight depends on the meteorological conditions. If the passenger has been promised a minimum duration of the flight and this could not be achieved, the passenger may reclaim the difference in the flight price pro rata to the actual flight time promised.

Further claims against the organizer are excluded.

Insurance of the passenger in the event of an accident

The passenger confirms that he/she is insured against the consequences of an accident (also during a hang gliding flight). There is no accident insurance through alpstein-paragliding.ch (Sven Albert) (or the pilot).

Photography and filming

Passengers are permitted to carry a small compact camera (GoPro type). This must be properly secured. The pilot makes a binding decision on the type and method of attachment. Cell phones and cameras with interchangeable lenses may not be used during the flight. The pilot may allow exceptions to this under (safety) conditions.

Jurisdiction for passengers from the USA or Canada

Passengers from the USA or Canada expressly waive jurisdiction in the USA or Canada for any disputes arising from the passenger flight and acknowledge that neither alpstein-paragliding.ch (Sven Albert) nor pilots flying for Sven Albert will accept jurisdiction in the USA or Canada.

Place of jurisdiction and applicable law

The ordinary courts at the registered office of alpstein-paragliding.ch (Sven Albert) are responsible for all disputes arising from the contract for the passenger flight. Swiss law shall apply exclusively.
